Ask what that percentage will be. Are there are any other costs that you will be responsible for? How will fees be calculated when your case is settled? Will you pay more the longer the case takes to settle?

Ask what happens if the case is unsuccessful. Will you owe them any money? Particularly ask about the repayment of disbursements. This is money that the law firm will spend during the handling of your case for things such as medical experts, private investigators, photocopying and courier services. Will you owe for these disbursements if your case is unsuccessful?

4. How long will it take to settle my case?

The length of time it will take to settle your personal injury case will depend on a number of different factors that are difficult to discern early on, primarily the nature and extent of your injuries and whether you need to go to trial. But, an experienced attorney may be able to give you a reliable estimate of how long your personal injury case may take based on his or her handling of similar cases in the past.

5. Who will be handling the case?

Often with larger law firms, your case will be handed off to an associate lawyer, another partner or somebody else. This isn’t necessarily a bad thing, you just want to know who will be doing most of the work, and whom you will be most in contact with––the attorney you are speaking with, a different attorney in the firm, or even a paralegal.

6. What is your firm’s communication policy?

This relates to how you will be able to contact your attorney and how quickly they will respond. You want an attorney who works tirelessly on your behalf, who communicates with you frequently and who attends to your needs promptly––not one who is slow to return your phone calls or emails.

You should feel free to ask any questions you have. You should also pay attention to the personal chemistry between you and the lawyer. No matter how experienced and well recommended a lawyer may be, if you feel uncomfortable in his or her presence, you may never develop a good attorney-client relationship.
